Preliminary Injunction Ruled On Request Of Sport Equipment Manufacturer Salomon S.A. Against Several Parties
SALOMON / EASYFIT PATENT DISPUTE
(EMAILWIRE.COM, December 21, 2006 ) Helsinki -- Sports Equipment manufacturer Salomon S.A. - www.salomonsports.com - a daughter company of Amer Sports Corporation - www.amersports.com - is litigating against Easyfit OU - www.poleabout.com - a pole strap manufacturer in Estonia, in Germany related to patent dispute of ski pole straps. District Court Mannheim case number 2 O 112/06
Court has ruled preliminary injunction as follows: Poleabout OU Easyfit, Anadeus Ltd. and Antti Kosunen and are barred from contacting licensees of Salomon in business with one or more of the following allegations for the purpose of competition:
• The features of novelty and inventive step, on which the patent EP 357 517 of the company Salomon S.A is supported, was known long before its priority day of June 21, 1988;
• It is obvious that the patent EP 357 517 of the company Salomon S.A. is not legally valid and may be nullified.
• It is obvious that the German part of the patent of the company Salomon DE 689 10 757, claim 12, may be nullified immediately. District Court Mannheim, 2nd Civil Chamber Decision file number 2 O 350/06:
“We, of course, respect the court decision but will also check it for the possibility of an appeal. We have analyses of the Salomon patent related to prior art, novelty, and innovative step as well as to the validity of the patent which we investigate for this purpose. We will not provide any of our conclusions in the meantime. Shortlist of patents in our analyses as well as other related information from for example sport museums are available, at cost, to any company currently paying license payments to Salomon.”.
