LegalView Supports NTSB Recommendation to Ban Cell Phone Use While Driving

The agency conducted several investigations. Through these studies and national safety data, the NTSB determined that distracting driving is a leading cause of automobile accidents in the United States, prompting their recommendation to ban non-emergency phone calls and texts for those operating the vehicle.
This new recommendation is the most far-reaching issued by the NTSB, which has been trying to limit hand-held and hands-free devices for the past 10 years. The agency has recommended a ban on cell phones and other portable electronics for commercial truckers, school bus drivers and novice drivers.
If adopted, the ban would not affect passengers' rights to use such devices.
Deborah Hersman, Chairwoman of the NTSB, says that distracted driving is a huge problem and needs to be controlled. According to a recent study by the National Highway Traffic Safety Administration, some 15.5 million drivers are on hand-held phones at any given moment.
Approximately 3,092 roadway fatalities involved distracted driving last year, says the study.
Another study by Virginia Tech found that a safety-critical event is 163 times more likely to occur if someone is texting, e-mailing or accessing the internet.
Hersman says that accident investigators constantly ask for protective orders to preserve smart phones as evidence in investigations. Recently, the NTSB conducted its investigation into a multi-vehicle accident last summer in Missouri and found it was caused by a nineteen-year-old driver who either sent or received 11 text messages in the 11 minutes before the crash- that's one text per minute.
The NTSB is also recommending that cell phone companies make phones that could disengage while a person is driving, but would work properly if the person was in the passenger seat.
The agency's action is only a recommendation, but it has been influential in leading changes in other areas of transportation safety.
Hersman says that the ban would inconvenience and upset many drivers, but it would save thousands of lives. She says that many of the recommendations that have made have been unpopular, but are the right thing to do.
