Injured Woman Sue Johnson & Johnson Over Synthetic Vaginal Mesh
Linda Gross received a vaginal mesh implant in 2006 and is suing the makers of the device, Johnson & Johnson, claiming negligence and defective product design.
(EMAILWIRE.COM, October 10, 2011 ) WATERTOWN, SD -- LegalView Has updated its vaginal mesh portal regarding a real life vaginal mesh complication. For Linda Gross, 46, of Watertown, S.D., a simple surgery to relieve bloating and constipation became a nightmare.
Gross experienced a pelvic organ prolapse - a condition in which the pelvic organs descend, or prolapse, into the vagina. This condition occurs as a result of a weakening of the pelvic floor muscles. Her doctor inserted a realitively new type of vaginal mesh called Gynecare Prolift into her vagina through incisions made in her vagina.
Ever since the surgery in 2006, Gross says she has had urinary complications, constant pain and swelling in her body as her body continues to reject the mesh. According to her, she cannot sit for longer than 20 minutes, cannot have sex with her husband, and she can't be active for more than a few minutes at a time. She has had twelve additional surgeries to correct the complications; all of them have failed.
Her story is not all that uncommon. Between 2008 and 2010, the United States Food and Drug Administration (FDA) received 1,503 reports of injury, infection, malfunction or death associated with the surgery. These reports represented a huge spike compared to previous years, which led the agency to release a warning to health care professionals about the device.
Currently, the FDA is considering pulling the device off the market, pending further safety data. The agency also convened a two-day meeting of the Obstetrics and Gynecology Devices Panel to discuss the next regulatory steps.
Meanwhile, Gross and 100 other women are suing the makers of the device- Johnson & Johnson's Ethicon, claiming negligence and defective product design. They are suing for compensatory and punitive damages. The company did not respond to several calls to find out more information about the Trans vaginal lawsuit, but in court filings the company has denied the allegations.
Vaginal mesh lawyers have received several complaints from women across the country. It has been estimated that approximately 500 lawsuits have been filed since 2010.
In the past, pelvic organ prolapse, or POP, was treated with a hysterectomy, or surgical removal of the uterus. Sutures were put in to add additional support and prevent further relapse.
While surgical mesh may seem like a better solution, it isn't for many woman since the device has been linked with so many complications.
