Auto Insurance Bill Approved by Kansas Lawmakers

The ‘no pay, no play’ bill that recently got final approval from the state’s legislative branch would make it so that uninsured motorists do not have full recovery rights following an accident

(EMAILWIRE.COM, May 04, 2011 ) Kansas City, KS -- Kansas legislators last week gave their approval to a bill that would stop uninsured and drunk drivers from having access to full recovery rights in the event of a serious accident.

The bill, which would establish a “no pay, no play” provision similar to the types already in place in a number of other states, would bar drivers who lack coverage from collecting for pain and suffering and other non-economic damages resulting from an accident, even if they were not at fault.

The Property Casualty Insurers Association of America has issued a statement urging the governor to sign the bill into law, saying the bill “will help to send a message that the state is cracking down on uninsured motorists by increasing the penalties for those who drive without legally required insurance.”

A similar measure was recently passed by the state legislature of Montana, but it was ultimately vetoed by the governor. He said in his veto message that there was not enough of a relationship between the punishment and the “status of the individuals upon whom the punishment would be imposed.” He also noted that members of the coverage industry had said the bill would help increase the availability of low cost insurance in the state, but no effective way of measuring the bill’s impact could be offered.

This is not the first time “no pay, no play” legislation has been debated in the Kansas Legislature. A nearly identical bill was introduced in 2006, and a similar bill that would have limited property-damage recovery rights was introduced in 2008, though neither was signed into law.
