SaaS Attorney Chip Cooper Explains What To Do When Law Enforcement Demands Archived Email

Leading SaaS Attorney Chip Cooper Helps SaaS Webmasters Avoid Legal Liability When Law Enforcement Demands Customer Email.

(EMAILWIRE.COM, February 26, 2011 ) Atlanta, GA - For SaaS websites, it's not a question of if, but when, a law enforcement official demands user email. Serious questions arise: What obligations do SaaS sites have, and what are their legal rights. How do they protect themselves from legal liability. Leading SaaS attorney Chip Cooper provides timely answers.

Cooper stresses the importance of emails to law enforcement: "Emails represent a treasure trove to law enforcement officials looking for evidence, and the current uptick in demands for emails reflects this", says Cooper.

"The problem is that most SaaS webmasters don't have a good understanding of what law enforcement must do the have a legal right to obtain these emails", continues Cooper. "Under the the Electronic Communications Privacy Act, for emails stored less than 180 days, law enforcement must first get a judge to authorize a search warrant. After 180 days, a simple subpoena is enough", continues Cooper.

A recent case in the 6th Circuit Court of Appeals ruled that the 180-day distinction no longer applies. "So, under this new ruling a search warrant is always required", states Cooper. "A lot of questions remain, and that's why I wrote my article - to help SaaS webmasters avoid liability".

“Today, more than ever – whether you’re an email marketer or not – it’s essential for webmasters to stay on top of legal developments”, says Cooper. Cooper believes he’s solved the dilemma with his bi-monthly, complimentary email newsletter, Website Law Alert. “It’s free, and you can sign up at our DigiContracts.com site.”
