Riddle & Brantley Reports $10 Million Lawsuit Filed in Fort Bragg Day Care Death
Parents of Suffocated Child File Wrongful Death, Negligence Lawsuit against U.S. Government
Surveillance footage shows Rachel Degenhard dropping Santino off at the Pope Child Development Center on the morning of March 9, where he was neglected for almost two hours before being laid face-down on a vinyl mat with a blanket placed under his stomach, causing him to suffocate without notice from the supervising worker.
Because the U.S. Attorney’s Office would not press criminal charges, the Degenhards filed a suit for wrongful death and negligent infliction of emotional distress against the federal government on Monday, September 30. The pair say they are, “heartbroken and disappointed,” at the decision, and felt that they were experiencing a miscarriage of justice.
If your child was harmed or killed while in the supervision of another person or day care facility, you may be able to ensure justice is done by contacting Riddle & Brantley for a free review of your case.
